Converting a special protection residence permit (art. 19)

Official explanation from Sindacato Labor

In light of Legge n. 50 del 5 maggio 2023 (Law no. 50 of 5 May 2023), which clearly states that, WHERE THERE IS AN EMPLOYMENT RELATIONSHIP, this type of residence permit is CONVERTED into a permesso di soggiorno per motivi di lavoro (work residence permit).

Special protection, art. 19(1.2) TUI (Consolidated Immigration Act).
Residence permits already issued under art. 19(1.2) that are still valid may be renewed once only, for a period of 1 year from their expiry date, and may be converted into a work residence permit if the legal requirements are met.

The type of employment relationship also determines the name of the NEW permesso di soggiorno you will receive.

Case 1.
YOU HAVE an employment contract, a contratto di lavoro subordinato (colf, badante – domestic worker, carer – and others)

• you can convert your art. 19 permit into a permesso di soggiorno per motivi di lavoro subordinato (residence permit for employment).

For the conversion you need to attach the following documents:

• previous permesso di soggiorno
• passport (first page and the pages with stamps)
• carta d’identità (identity card) and codice fiscale (tax code)
• comunicazione di ospitalità (declaration of hospitality) or autocertificazione della residenza (self-declaration of residence) (NB: residenza is not required to renew a permesso di soggiorno);
• employment contract and latest payslip (or latest INPS payment slip for domestic workers)
• tax return or CU form (if the CUD has not yet arrived, bring all your payslips).

Your employer must also provide a statement confirming the employment relationship both at the time of the application and on the day you have to go to the Questura (the local immigration office) to have your fingerprints and biometric data taken.
This document is called the Dichiarazione di continuità del rapporto di lavoro S-3 (declaration of continuity of employment); you must also attach a photocopy of the employer’s identity card (fotocopia della carta d’identità del datore di lavoro).

Please note that an employment relationship is the main condition for converting your permesso di soggiorno protezione SPECIALE ART 19.

Payment:
€16.00 marca da bollo (revenue stamp)
€30.00 post office service fee
€80.46 for printing the electronic document
Payment is made by bollettino postale (postal payment slip) to the postal account of the Ministry of Economy and Finance – Treasury Department (Ministero dell’Economia e delle Finanze – Dipartimento del Tesoro), with the description “importo per il rilascio del permesso di soggiorno elettronico” (fee for issuing the electronic residence permit).
Note that if the contract is tempo determinato (fixed-term – the contract ALREADY states the period of employment), the fee for printing the electronic document is €70.46.

Case 2.
You have a partita IVA (VAT number – you are self-employed)

• on conversion you will receive a permesso di soggiorno per lavoro autonomo (residence permit for self-employment).

Under art. 5(3-quater) of D.Lgs. 286/98, foreign nationals holding a residence permit for self-employment may reside in the territory of the State.

For the conversion you need to attach the following documents:

• previous permesso di soggiorno
• passport (first page and the pages with stamps)
• carta d’identità (identity card) and codice fiscale (tax code)
• comunicazione di ospitalità (declaration of hospitality) or autocertificazione della residenza (self-declaration of residence) (NB: residenza is not required to renew a permesso di soggiorno);
• Attribuzione Partita IVA (VAT number assignment);
• registration with the Camera di Commercio Industria Artigianato (Chamber of Commerce) or a recent visura camerale (company register extract);
• the authorisation or licence, or registration in the relevant professional register or roll, or the declaration or notification required by current legislation for the professional activity carried out;
• tax return and provisional balance sheet (if available).

Payment:
€16.00 marca da bollo (revenue stamp)
€30.00 post office service fee
€80.46 for printing the electronic document.

Please bear in mind that if minor children live with you, the documents to submit depend on the child’s age.

For children aged 0 to 14, the child’s details are entered in the application of one of the parents.
The fee for printing the child’s electronic document is €30.46.

For children aged 14 to 18, a separate application is made, with the child’s details and signature.
The payments are as follows:
€16.00 marca da bollo (revenue stamp)
€30.00 post office service fee
€30.46 for printing the electronic document
