Ukrainians’ right to civil disability benefits in Italy and the new 2026 reform

Ukrainian citizens who live legally in Italy and hold a residence permit (permesso di soggiorno) valid for at least one year are fully entitled to civil disability (invalidità civile) benefits on the same footing as Italian citizens.

Italy is in the process of implementing a landmark reform of the social protection system for people with disabilities, adopted by Decreto Legislativo 62/2024. The reform officially began with a trial phase on 1 January 2025 and is due to come fully into force throughout the country from 1 January 2027.

One of the most important changes is that from 2026 INPS (National Social Security Institute) becomes the single body responsible for carrying out the medical assessment and awarding benefits.

The main types of support for people with disabilities

In this section we look in detail at the forms of support available to people with disabilities in Italy and the conditions for receiving them. It covers all the key types of benefit provided for by law and will help you find your way around the social protection system in 2026.

  1. Invalidità civile 100% (total incapacity for work)

This status is granted to people with a total and permanent incapacity for work.

Pensione di inabilità (incapacity pension): in 2026 the monthly payment is €340.71

Income limit: to receive this benefit, your annual personal income must not exceed €20,029.55

Maggiorazione (supplement): pensioners aged 18 to 67 can receive a supplement of up to €407.58 a month, which is reduced according to personal or joint (spousal) income

2. Indennità di accompagnamento (attendance allowance)

A person recognised as totally incapacitated who cannot walk unaided or carry out the activities of daily living on their own is entitled to this payment

It is a cash benefit paid to people who need constant assistance from another person.

Amount for 2026: the monthly payment is €551.53

Main requirements:

Recognition of inabilità totale e permanente (100% disability)

Being unable to walk without the constant help of a companion, or unable to carry out the activities of daily living without assistance from another person

Italian or EU citizenship or, for foreign nationals, a residence permit valid for at least one year

No limits: this allowance is paid regardless of the applicant’s annual personal income and age

Compatibility: the allowance is compatible with work (employed or self-employed) and with holding a special driving licence (patente speciale)

Important restrictions:

Payment is suspended if the person is in hospital at public expense for more than 29 days

It cannot be combined with similar benefits for disability resulting from war, work or service (although the person may choose the more favourable option)

3. Invalidità civile 74-99% (partial disability)

Assegno mensile (monthly allowance): people with a disability rating of 74% to 99% receive €340.71 a month.

Income limit: this benefit has a much lower annual income limit of €5,852.21

4. Indennità di frequenza (school attendance allowance)

This payment is for minors who have persistent difficulty in performing the tasks and functions appropriate to their age.

Amount: in 2026 it is €340.71 a month

Income limit: the annual income limit for entitlement is €5,852.21

5. Pensione di inabilità ordinaria (Law 222/84)

This benefit differs from civil disability because it is based on the contributions paid (contributi), not just on the person’s health.

Contribution record: this falls under the category of invalidità contributiva (contribution-based disability). Under Italian law, to receive it you normally need at least 5 years of insurance and 3 years of contributions (contributi) in the 5 years before applying.

Condition: the benefit is awarded to people whose capacity for work has been totally and permanently lost through illness or physical or mental impairment

6. Iscrizione nelle liste speciali al collocamento (special employment lists)

Under Legge 68/99, people with disabilities are entitled to targeted job placement (collocamento mirato).

Single procedure: from 2026, eligibility for targeted job placement is assessed directly by INPS as part of the “basic assessment” (valutazione di base).

Medical certificate: the doctor completing the introductory medical certificate (certificato medico introduttivo) must tick the box for Collocamento mirato (legge 68/1999).

Assessment on the papers: in some cases the commission may confirm entitlement to job placement solely on the basis of the medical documents submitted (valutazione sugli atti). This may require filling in the special Questionario L. 68/99

Administrative declarations (ICRIC, ICLAV, RED, AP70)

To receive or keep receiving benefits, you must report your socio-economic details to INPS.

Hospital stays and work (ICRIC/ICLAV): you must give information on any in-patient hospital stays (which affect the Indennità di accompagnamento, suspended if a hospital stay at public expense lasts more than 29 days) and on any work.

Modello AP70: this form is used to submit socio-economic details. It is essential for minors once the medical requirements have been confirmed, and for those turning 18, so that they move automatically to the incapacity pension without new medical examinations.

RED (income declaration): pensioners must submit income declarations to confirm that they meet the legal requirements.

How to apply (2026)

For residents

of provinces where the reform is already under way (for example Rome, Milan, Turin), the procedure begins when the doctor sends the Certificato medico introduttivo (introductory medical certificate), which automatically starts the assessment without the need for a separate administrative application.

In other regions, until the end of 2026, you must still submit both the medical certificate and the administrative application, through the INPS website or the patronati (welfare advice offices).

The application must include your dati socioeconomici (socio-economic details), in particular information on any work or hospital stays.

To complete this overview of the benefits and procedures relating to civil disability in 2026, below is detailed information on registering on the special lists for targeted job placement:

The assessment procedure

Under the disability reform, eligibility for collocamento mirato is now assessed as part of the “valutazione di base” (basic assessment), which from 1 January 2026 is carried out exclusively by INPS. The aim is to simplify the process by making the Institute the single body responsible for recognising the benefits provided for by law.

How to apply (after the 2026 reform):

In provinces where the new procedure is already in place, a separate administrative application is no longer needed.

How to apply (old procedure)

In regions not yet covered by the trial roll-out of the reform (until 31 December 2026), the medical certificate must still be accompanied by a separate administrative application for recognition of disability under Law 68/99.
