The large-scale refugee crisis in Europe, ongoing since 24 February 2022, was caused by the invasion of Ukraine by Russian troops. In response, on 28 March 2022 the Italian Government implemented Council of the European Union Decision 2022/382 on temporary protection.
Under the Decree of the President of the Council of Ministers (DPCM), the beneficiaries of temporary protection are
- citizens who were living in Ukraine before the armed conflict began;
- stateless persons;
- third-country nationals who enjoyed international protection or equivalent protection in
Ukraine before 24 February 2022; - third-country nationals who were legally residing in Ukraine before 24 February 2022 with a
permanent residence permit; - family members of these categories (spouse or unmarried partner,
minor children, unmarried adult sons/daughters and parents dependent on the beneficiary
of temporary protection)
Paragraphs 395–396 of Law No. 213 of 30.12.2023, “State budget forecast for the 2024 financial year and
multi-year budget for the three years 2024–2026” (Bilancio di previsione dello Stato per l’anno finanziario 2024 e bilancio pluriennale per il triennio 2024-2026), govern the stay
of Ukrainian refugees in Italy, namely:
Paragraph 395 Residence permits (permesso temporaneo) issued up to 31 December 2023 to beneficiaries of temporary protection under Council Implementing Decision (EU) 2022/382 of 4 March 2022, establishing the existence of a mass influx of displaced persons from Ukraine within the meaning of Article 5 of Council Directive 2001/55/EC of 20 July 2001, remain valid until 31 December 2024. The residence permits referred to in the first sentence may lose their validity and be revoked even before they expire if the Council of the European Union adopts a decision ending temporary protection.
Paragraph 396 The residence permits referred to in paragraph 395 may be converted into a residence permit
for work (permesso di soggiorno per lavoro) at the request of the person concerned.
What does the conversion of a residence permit under paragraph 396 of Law No. 213/2023 of
30.12.2023 mean?
Converting a residence permit is an administrative procedure by which
a foreign national who already holds a residence permit in Italy obtains a residence permit for a reason other than the original one, provided the conditions laid down by law are met. A temporary permit can be converted into a work permit when you have an employment contract for at least 20 hours a week. To do this, go to the Sportello Amico di Poste Italiane (the dedicated Poste Italiane counter), fill in the postal kit (the KIT with the yellow stripe) and send it to the Immigration Office (Ufficio Immigrazione) of the Questura (provincial police headquarters) for the place of residence/domicilio of the person concerned.
Basic documents needed to apply for conversion:
– fill in the KIT (with the yellow stripe), which you can collect at the post office (Sportello
Amico di Poste Italiane) or at a CAF (tax assistance centre);
- Permesso di soggiorno (residence permit);
- Passport or identity card (passaporto o carta d’identità);
- Employment contract (contratto di lavoro), minimum 20 working hours a week;
– certificate of residence (certificato di residenza), issued by the Comune where you are registered as resident;
– family status certificate (certificato di stato di famiglia), issued by the Comune; - Tessera sanitaria (health card), codice fiscale (tax code);
- The employer’s documento d’identità (identity document);
- Income tax return for the previous year (if you had any income);
- Photocopies of your last 3 payslips (buste paga) or photocopies of the INPS (National Social Security Institute) payment receipts for
the last 3 months (note: this applies if the contract was signed earlier, for example in
2023; if the contract is new, you will not yet have any contribution payments). - Marca da bollo (revenue stamp) of 16 euros;
- 30 euros for postal services;
- 80.46 euros for the plastic permit card.
I would like to draw your attention to conversion when you have a Partita IVA (VAT number).
A foreign national who intends to carry out an industrial, professional, craft or commercial activity in Italy
must also - demonstrate that they have adequate resources for the activity they intend
to carry out in Italy; - meet the requirements laid down by Italian law for carrying out
the self-employed activity, including, where necessary, the requirements for registration in
professional registers; - hold a certificate from the competent authority, issued no more than 3 months earlier, stating
that there are no obstacles to issuing the authorisation or licence required for the activity that
the foreign national intends to carry out.
In any case, you must demonstrate that you have suitable accommodation and an annual income above the minimum level set by law.
Basic documents for self-employed people with a Partita IVA
- Permesso di soggiorno (residence permit);
- Passport or identity card (passaporto o carta d’identità);
– certificate of residence (certificato di residenza), issued by the Comune where you are registered as resident;
– family status certificate (certificato di stato di famiglia), issued by the Comune; - Tessera sanitaria;
- Reddito (income) for the previous year (if any)
- Certificato di attribuzione della Partita IVA (VAT number allocation certificate)
- Copy of the iscrizione alla Camera di Commercio (Chamber of Commerce registration)
- Marca da bollo of 16 euros
- 30 euros for postal services
- 80.46 euros for the plastic permit card
