INPS and the repayment of benefits
INPS (Istituto Nazionale della Previdenza Sociale, the National Social Security Institute) is the public body that handles the payment of pensions, social benefits, insurance contributions and other services for Italian citizens and for foreigners who work or live in the country.
INPS provides benefits subject to certain conditions, which must be met in order not to lose the entitlement. These conditions may concern income, status, documents, employment and other factors. If the recipient does not meet them, INPS may discover this during a check and demand repayment of the sums paid out unduly.
Repayment to INPS must be made within 30 days of receiving the relevant notice. If this obligation is not met, INPS may apply financial penalties and also take legal action to recover the debt.
Anyone who disagrees with an INPS decision on repayment can challenge it through an administrative appeal or in court. To do so, you must file an appeal with INPS within 60 days of receiving the notice, or bring a lawsuit within 180 days of receiving the notice. In any case, it is advisable to consult a qualified lawyer who can provide professional advice and assistance.
