Citizenship by residence (10 years of continuous residence) – cittadinanza per residenza (by naturalisation).
Dear citizens of Ukraine, if you have been living in the Italian Republic continuously and lawfully for 10 years and meet certain mandatory requirements, you are entitled to apply for citizenship by residence through naturalisation under Italian law, on the basis of art. 9 lett.f legge n.91 del 5.02.1992 (Concessione della Cittadinanza per RESIDENZA (art. 9 L. 91/92) – the granting of citizenship by residence
Italian citizenship by place of residence (by naturalisation)
Requirements and documents
Citizenship may be granted by naturalisation to a foreign national (in our case, a citizen of Ukraine) who has been lawfully resident in Italy for:
10 years (for non-EU citizens (extracomunitari) (art. 9 lett. f))
Besides the requirement of 10 years of continuous lawful residence in Italy, there are other mandatory requirements, such as:
sufficient financial means to support yourself, and regular fulfilment of your tax obligations.
Income is assessed over the three years preceding the application, and it must remain stable and continuous right up until the oath is taken.
To this end, under the regulations in force (parameters set by D.L. 382/89, art.3, converted into L. 8/1900, confirmed by art. 2 of L. 549/1989), –
income must be at least 8 263,31 euros for an applicant with no dependent spouse or children; 11 362,05 euros for an applicant with a dependent spouse; plus 516,00 euros for each dependent child of the applicant.
If the required income is wholly or partly lacking over the last three years, it can be combined with the income of other family members living with the applicant. In this way the income of the whole household is assessed, not just that of the individual applicant, in keeping with the principle of family solidarity.
Under Italian law, family members are the persons listed in Article 433 of the Civil Code (spouse, civil partner or de facto cohabiting partner bound by a written cohabitation agreement, children born in or out of wedlock, parents, sons- and daughters-in-law, father- and mother-in-law, full and half brothers and sisters). (art.433 del Codice Civile (coniuge, parte unita civilmente o convivente di fatto legato da contratto scritto di convivenza, figli legittimi o legittimati, genitori, generi e nuore, suocero e suocera, fratelli e sorelle germani e unilaterali));
no criminal record and no danger to society;
knowledge of the Italian language.
Throughout the processing of the application and when the oath is taken, all the legal requirements for the granting of citizenship must continue to be met, namely continuous lawful residence in Italy and the minimum earning capacity stated above. Failure to meet these requirements will lead to the application being rejected.
IMPORTANT: any change of residence must be reported to the Ufficio Anagrafe (registry office) (modulo variazione residenza, the change-of-residence form) and also to the Prefettura (prefecture).
Documents: birth certificate / CERTIFICATO DI NASCITA (translated into Italian and legalised), requested in your country of origin (it does not expire). See here.
Important: if you took your husband’s surname, make sure your birth certificate shows both your maiden and your married surname. You may therefore also need a document or certificate attesting the change of your surname, if you changed it.
Criminal record certificate / CERTIFICATO PENALE: the certificate must be apostilled, translated and legalised (valid for 6 months from the date of issue, unless the certificate states otherwise).
Important: if the applicant has lived in third countries, a criminal record certificate must be provided for each of those countries.
Passport. A photocopy of your valid passport or identity document is required.
Permesso di soggiorno / residence permit. A photocopy of your valid residence permit is required.
Codice fiscale (tax code). A photocopy of your valid codice fiscale is required
Carta d’identità (Italian identity card). A photocopy of your valid identity card is required.
Certificate of Italian language proficiency at no lower than B1 level, or a Licenza Media (lower secondary school leaving certificate) issued by a state or state-recognised school or by a certification body.
Important: the certificate is not required only for holders of an EU long-term residence permit (permesso di soggiorno UE di lungo periodo).
Historical residence certificate / Certificato storico di residenza. If you have lived in different municipalities (comune), you will need to provide a certificate from each municipality where you had your official residence (residenza). It must be requested from the Comune.
Important: a break in residence is one of the reasons applications are often rejected.
Self-declaration of current family status / Autocertificazioni dello stato di famiglia attuale
You can find the forms you need on the official websites, for example (DICHIARAZIONE SOSTITUTIVA DI CERTIFICAZIONE DELLA RESIDENZA E DELLO STATO DI FAMIGLIA (art. 46, D.P.R. 445/2000) – self-declaration replacing the certificate of residence and family status).
Income received over the last 3 years. Modello CU, Unico or modello 730 (colf, badanti and other domestic workers can instead provide a statement from INPS, the National Social Security Institute).
Receipt for payment of the 250,00-euro fee (payment online only, on the portal through the PagoPa system)
16-euro revenue stamp / Marca da bollo da 16 Euro
IMPORTANT:
Check all official documents very carefully, and if there are discrepancies between different official documents, whether Italian or Ukrainian, you must present a consular declaration (dichiarazione consolare).
Also, if you changed your surname as a result of marriage and it is not shown on your birth certificate, you must present your marriage certificate, translated and legalised, or a consular declaration (dichiarazione consolare).
